Terms and Conditions – Next Fatfreeze Clinics

1. Definitions

In these terms and conditions, the following definitions apply:

• Treatment: All actions, including examinations and the provision of advice, directly relating to the Client, performed by or on behalf of Next Fatfreeze Clinics.
• Treatment Agreement: Any agreement between the Client and Next Fatfreeze Clinics relating to a treatment.
• Next Fatfreeze Clinics: The company with locations in Amsterdam and Rotterdam, including any affiliated independent medical professionals and consultants.
• Client: The individual who enters into a Treatment Agreement with Next Fatfreeze Clinics.

2. Applicability

These terms and conditions apply to the formation and execution of every Treatment Agreement between the Client and Next Fatfreeze Clinics. Deviations from these terms are only valid if explicitly agreed upon in writing by Next Fatfreeze Clinics. Any terms and conditions of the Client are expressly excluded.

3. Formation of the Treatment Agreement

The Treatment Agreement is established once the Client gives consent for a treatment by Next Fatfreeze Clinics. Prior to this, an initial consultation will take place during which the Client will be informed about:

• The recommended number of treatments;
• Expected results;
• Potential risks and side effects;
• Pricing and payment methods.

The Client is required to provide truthful and relevant information. Additionally, the Treatment Agreement form must be completed, signed, and submitted before treatment can begin. A valid legal ID must also be presented.

4. Execution of the Treatment

Next Fatfreeze Clinics shall carry out the treatment to the best of its knowledge, ability, and in accordance with professional standards. If necessary, parts of the treatment may be performed by third parties without prior consent from the Client. Medical professionals and consultants associated with the clinic are bound by a duty of best effort, not a guarantee of results.

5. Suspension and Termination

Next Fatfreeze Clinics reserves the right to suspend or terminate the agreement if:

• The Client behaves inappropriately or disrespectfully towards staff or other clients;
• Circumstances beyond the control of Next Fatfreeze Clinics arise (force majeure).

During a force majeure event, all obligations are suspended. If the situation persists for more than three months, either party may dissolve the agreement without liability for damages. If part of the agreement has already been fulfilled, that portion will be invoiced accordingly.

6. Cancellations and No-Shows

• Cancellations made within 48 hours of the appointment will incur a €30 fee.
• Cancellations made within 8 hours or failure to appear will incur a €90 fee.

These charges compensate for the time reserved in our schedule.

7. Payment

• Full payment must be received no later than 5 days before the first treatment.
• Clients are responsible for submitting claims to their insurance provider, if applicable.
• Next Fatfreeze Clinics may suspend treatment if payment has not been received.
• Failure to pay on time results in automatic default, without the need for formal notice.

Please note:
All deposits, whether full or partial, are non-refundable. In case of cancellation (written or verbal), Next Fatfreeze Clinics is not obligated to return any deposit. A deposit constitutes acceptance of our terms and confirms the reservation of your treatment appointment.

8. Client Records

A personal file is created for every Client. Next Fatfreeze Clinics retains client records in accordance with the legally required retention period.

9. Confidentiality

Next Fatfreeze Clinics is obliged to maintain confidentiality with respect to all personal and confidential information received from the Client, unless legal disclosure is required. Data may be used anonymously for statistical or research purposes, provided it cannot be traced back to individual clients.

10. Liability for Personal Belongings

Next Fatfreeze Clinics is not responsible for loss or damage to the personal property of Clients. Clients are advised to take proper care of their belongings while on the premises.

11. Liability of Next Fatfreeze Clinics

The liability of Next Fatfreeze Clinics is limited to the invoiced amount, insofar as it is covered by its liability insurance.
Filing a complaint does not suspend the Client’s payment obligation. If correction is possible, Next Fatfreeze Clinics will carry it out at no additional cost.

12. Complaints Procedure

Next Fatfreeze Clinics is committed to high-quality service and client satisfaction. Should you have any concerns or dissatisfaction, we encourage you to contact our management. We will make every effort to find an appropriate solution together.

13. Applicable Law and Disputes

All agreements between the Client and Next Fatfreeze Clinics are governed exclusively by Dutch law. Any disputes will be submitted to the competent court in Amsterdam.
